The purpose of criminal justice system

The purpose of criminal juistice system is to protect the right of people.

there are two types of matters. i.e

  1. i) state matters 
  2. ii) criminal matters
  3. i) state matters:-

   in which state is directly involve.

  1. ii) Criminal matters:-

Criminal matters are those matters in which the one voilates and the another one is the one is voilated and the third one is the state.

Why would someone be punished:

 The purpose of award of punishment is to, not repeat the same crime again by someome else . According to different theories the criminal or the one who committs a crime would be panished for some reasons which are discussed below one by one.

There are four different theories regarding the punishment of crime:

Dererrent theory

Preventive theory

Reformative theory

Retributive theor

  1. Deterrent theory

(to Discourage or to de terrify)

 According to this theory, if a person commits a crime the state should award him /her(the criminal) a sever punishment, the state should make him/her an example for other, so that the others doesn’t dare to do so.

  1. preventive theory

The only concentrate on disabling of criminals. (Jail, death sentence, exile). If you disable the criminal will he be able to do the crime again no.

This theory says that if a person commits a crime then he/ she would be made disabled if a person is disabale will he be able to do the same crime agian definitely no but this thoery is not the perfect one

3 . Reformative theory

 According to the supporter of this theory physical, intellectual, Moral traning should be given to the criminal in order to improve his character. This theory states that No one is criminal by birth but he/she is commits crimes because of society. This theory says if someone committ a crime she/he has some psychological issues. We should do proper treatment of this person.

  1. Retributive theory

 According to this theory ” The same punishment should be ewarded to the criminal which the criminal do with others”.

i.e Tooth for tooth, eye for eye and life for life.

If someone cause a loss of 20 ropees to someone then criminal shoul be fined 20 ropees and it will be given back to the victim.
